Software Copyright Infringement

We represented a healthcare technology company in multiple disputes with a third-party application developer involving claims of copyright infringement and breach of licensing agreements related to the alleged misuse of the developer’s software. We had to conduct an extensive investigation of the client’s and developer’s code, as part of developing legal and factual defenses to multiple related claims. In the first case, where liability was undisputed at trial, we ultimately were able to obtain a trial result that was less than 3% of the opposing party’s damages claims. In a second action, we resolved the case successfully before trial in a confidential settlement.
